Terms, conditions and privacy policy

By accessing this site:
1.  You agree to be legally bound by the terms, conditions and privacy policy. If you do not agree to be legally bound by these, please do not access and/or use this site.
2.  You accept that the terms, conditions and privacy policy may change from time to time. While efforts will be made to inform you, you agree to review the rules yourself on a regular basis. You agree to be legally bound by the terms as they are updated and / or amended.
3.  You agree to be legally bound by other rules mentioned within the site and you agree not to post any abusive, obscene, vulgar, slanderous, hateful, threatening, sexually-orientated or any other material that may violate any laws be it of your country, the country where this site is hosted or elsewhere.
4.  You agree that, at our discretion users may be immediately and permanently banned, without notice or discussion, and your Internet Service Provider may be notified if deemed required by us. The IP addresses of all posts are recorded to help enforce these conditions.
5.  You agree that forums, topics and / or posts may be removed, edited, moved or closed any time should we see fit.
6.  You agree to any information you have entered being published and / or stored in a database and that "cherry UK Ltd." and its related companies are permitted to use this information for any propose whatever including sending promotional items such as regular email newsletters from which you can unsubscribe at any time.  When you post, you expressly grant cherry (UK) Ltd or its future owners, a perpetual, unlimited free license to republish the content and to redistribute / make available and / or sell that content in print or electronic form anywhere in the world as part of an edited compilation or otherwise.
7.  You accept that cherry UK Ltd and it's related companies shall not be held responsible for any hacking attempt that may lead to the data being compromised.
8.  You accept legal responsibility for any and all damages suffered by individuals or companies as a result of posts made using your user ID and password and that no liability whatever attaches to cherry UK Ltd and its related companies.
9.  You accept that no selling, advertising or promotion is allowed and all posts must be factual and professional. The forum should be used in a way that will create benefit and improvement and represent the industry in a positive light.
10.  You accept that the forum will NOT be moderated and cherry reserves the right to remove access, topics or posts at any time without notice.
11.  You accept that this site is about sharing information but that none of the information may be accepted as correct, complete or accurate.
12. You accept that any information shown in the forum does not address anyone's individual requirements. In particular, you accept that information on the forum in no way constitutes any form of advice, recommendation, representation, endorsement or arrangement and must not be relied upon as a basis for decision making.  You accept that you must always carry out your own research into any product or service.
13.  You accept that while this site may contain links through to other sites, cherry (UK) Ltd have no control over the accuracy or completeness of information held thereon. You accept that you and not cherry (UK) Ltd are fully responsible should you choose to use the information and also for verifying it and for any decision to purchase or accept any of the services or products.  If you do purchase or use products or services from another website, you accept that you must agree with their terms and conditions beforehand. You accept that any contract in respect of such products or services will not be with cherry (UK) Ltd.
14.  Should you visit other site via links on this site, you accept that any information you pass on will be dealt with in line with their privacy polices and not those of cherry (UK) Ltd.
15.  You accept that some of the links included on this site are affiliated or advertising links which means that we may receive or have received a fee.
16.  You are welcome to link to our site providing you comply with the terms set out in this section and all applicable laws and providing you seek our permission by emailing info@cherryplc.co.uk first. Any site may display logos / tiles / banners as sent and agreed by cherry (UK) Ltd.  Otherwise, there must be no use of any cherry (UK) Ltd trade marks without our written consent.  These must not be removed, distorted or otherwise changed including changes to size without our prior consent.  Link locations / destinations must be agreed in advance and there must be no implication whatever that third party products and / or services are being in any way endorsed.  There must be no misrepresentations of us or our relationships and no false information about us must ever be given.  It is not appropriate for links to be on any site that infringes any intellectual property or other rights or that otherwise does not comply with all relevant laws and regulations and the site must not contain content that could be considered distasteful or offensive.  You accept that we have the right to require that any link is removed immediately should we wish and  that we may take whatever other appropriate action as we see fit.
17.  All of the structural content of this site is owned by cherry (UK) Ltd and is protected by UK and European copyright laws.  You may make one copy of extracts from the forum of this site on any single computer for personal, individual use only, provided that all copyright and proprietary notices are intact. That apart, content may not be republished, posted, transmitted, stored, sold, distributed or modified without the prior written consent of cherry (UK) Ltd.
18.  You accept that your access to this site, or its content, will not always be delivered uninterrupted, timely or error-free, or that the site will be free from viruses or other harmful properties. It is your responsibility to implement satisfactory safeguards and procedures to make sure any files you obtain through our site are free from such contaminations or other harmful properties.
19.You agree that under no circumstances will cherry (UK) Ltd be liable for any direct, indirect, incidental or other type loss or injury resulting from site use of any kind.
20.  You agree not to use this site for anything other than lawful and ethical purposes.  You will not post any material that infringes the intellectual property rights or other rights of others or post any material that is unlawful, obscene, defamatory, threatening, harassing, abusive, hateful, or embarrassing to any other person as determined by us in our sole discretion

26.  You agree never to engage in anything that restricts or inhibits any other person from using or enjoying this site, or anything which, in our judgment, exposes cherry (UK) Ltd. to any liability or potential detriment whatsoever
27.  You agree never to make false or misleading statements of any kind including those relating to investments, their price or their prospects. If you do, you may be committing a criminal offence.
28.  You agree never to post any material that could result in any sort of manipulation of the market value of any investment. If you do so, you may be committing a criminal offence.
29.  You agree never to give investment advice or make financial promotions.
30.  You agree that information posted on this site may be simply the opinion of the person posting and that this in no way reflects the views of cherry (UK) Ltd. You accept that, at times, there may be posts shown that are misleading, deceptive, or incorrect.
31.  You agree to inform info@cherryplc.co.uk of any abuse or inappropriate behaviour.  If you feel you have been threatened, damaged or abused in any way or if you believe that your rights have in any way been infringed, please contact us at info@cherryplc.co.uk  
32.  In the event that cherry (UK) Ltd. excludes you from posting, you agree not to re-register even in another guise.  If you do so, you agree to pay for the administrative and other costs incurred by cherry (UK) Ltd at a rate of £100 per hour, including the legal costs of recovery.
33.  You accept that if cherry (UK) Ltd suspects that you are guilty of any illegal act, you will be reported to the appropriate authorities.
34.  You agree to indemnify cherry (UK) Ltd against any claim, liability, cost, damage or loss that may be incurred (including our reasonable legal fees) as a result of anything you post and / or any actions you take which disrupt access to and / or the correct functioning of this or any other sites owned by cherry (UK) Ltd and / or any breach of these Terms and Conditions.
35.  If any of these provisions is deemed invalid, void or unenforceable that provision will be deemed severable from the rest and will not affect the validity and enforceability of any remaining provisions.
36.  This site is directed to users in England, Scotland, Wales and Northern Ireland only unless otherwise specified.
27.  These Terms shall be governed by English Law and any disputes will be resolved exclusively in the English Courts.
28.  You accept that in the event that all or part of cherry (UK) Ltd. were transferred or sold, the purchaser would be entitled to use that information in a way consistent with these Terms and Conditions
29.  You accept that there are risks relating to security of information posted or disclosed and you agree that cherry (UK) Ltd is not responsible for any breach of security.
